Your lawyers representing parent's interests in cases involving the Director of Youth Protection (DYP) in Greater Montreal Metropolitan Area: Montreal, Westmount, Laval, Longueuil, Brossard
When the Director of Youth Protection (DYP) retains a report on the grounds that the safety of the child is compromised, it can be destabilizing for a family. Do not hesitate and immediately contact one of our lawyers, seasoned litigators in family and youth protection matters.
Once a report has been retained by the Director of Youth Protection, urgent measures will need to be taken. Despite this urgency, those involved, including parents or individuals acting as legal guardians, and the child, have the right to be heard and they have the right to take all necessary steps to assure that their rights be respected.
The Youth Protection Act, CQLR c P-34.1 encourages family unity and obliges the DYP (Director of Youth Protection) to help and support families in need. Therefore, even in cases where a report has been retained, the DYP must assist the family in remedying the situation that led to the report and to help to the parents to regain custody or access rights to the concerned child.
Several measures are put in place by the Youth Protection Act to help families maintain custody of their children; we will guide you to implement them and thus eliminate the grounds for compromise.
In specific cases, custody of the concerned children may be sought by other family members, such as grandparents, an uncle, or an aunt. This request may be accepted if certain conditions are met because the ultimate goal is for the child to remain in their family environment.
In family and youth protection matters, the best interests of the children are the cornerstone of any intervention and judicial decision.

Frequently asked questions
Which documents shall I bring to the first meeting?
If the DPJ has retained a report (signalement), you must bring all documents you have received from the DPJ. If you were informed that an urgent hearing will take place tomorrow before the Youth Division of the Court of Quebec, you must also bring the Demande pour mesures immédiates (application for immediate measures) you received from the DPJ. Of course, you must also bring valid photo identification.
Who is the best lawyer to face the DPJ?
The best lawyer to face the DPJ is one who combines experience and expertise in youth protection matters, particularly in cases where the DPJ has wrongfully retained a report involving allegations of psychological abuse, neglect, sexual abuse, or physical abuse, and where, in general, a child’s safety is allegedly compromised.
An excellent lawyer will know how to listen to clients and offer a personalized approach tailored to each situation. They will provide appropriate legal advice and ensure effective representation of the parents' interests.
With in-depth knowledge of the applicable laws — such as the Youth Protection Act, CQLR c. P-34.1 — and of the procedural rules before the Youth Division of the Court of Quebec, such a lawyer will do everything possible to clarify any misinterpretation of the file by the DPJ, where applicable, and to achieve a favourable outcome for the parents and their children.
I need a lawyer to challenge a DPJ decision. How can I book an appointment?
You can call us at (514) 600-6025 or fill out our online form.
If your situation is particularly urgent - for example, if you have just learned that the DPJ intends to file an Application for Immediate Measures the following day - we will do our best to offer you a same-day appointment, even outside regular office hours.
